Terms of Service

By accessing or using <divs> ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. The Service

<divs> is a platform for building, previewing, and exporting UI components. The Service includes:

  • A Canvas Editor for creating and editing components with AI assistance
  • A component library for browsing and copying pre-built components
  • Export functionality for Webflow and other formats

2. Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You may not share your account or allow others to access it.
  • One account per person. Multiple accounts for the same individual are not permitted.
  • We may suspend or terminate your account at any time, for any reason, without notice.

3. Subscriptions and Payments

  • The Service offers Free and Pro subscription tiers.
  • Pro subscriptions are billed on a recurring basis (monthly or annually).
  • Prices are subject to change with 30 days notice. Changes apply at your next billing cycle.
  • All subscription payments are non-refundable. You may cancel at any time, but no refunds will be issued for unused portions of your subscription.
  • Payment processing is handled by Stripe. By subscribing, you also agree to Stripe's terms.

4. Usage Limits

  • AI features are subject to usage limits that vary by subscription tier.
  • We may adjust usage limits at any time without prior notice.
  • Exceeding usage limits may result in throttling or temporary restriction of AI features.

5. User Content and Ownership

  • You own the components you create. All components generated through the Service belong to you.
  • You may use your generated components for any purpose, including commercial use and resale to clients.
  • By using the Service, you grant us a limited license to process your content solely to provide and improve the Service.

6. AI-Generated Content

  • Components are generated using third-party AI services.
  • Your prompts and interactions with the Service may be used to provide and improve our services, as described in our Privacy Policy.
  • You are responsible for reviewing all AI-generated output. AI may produce errors, inaccuracies, or unintended results.
  • You are solely responsible if AI-generated content infringes third-party intellectual property rights. We are not liable for such claims.

7. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to generate malicious code, including phishing pages, malware, or scripts designed to harm users
  • Abuse, spam, or overload AI features beyond normal use
  • Circumvent or attempt to bypass usage limits
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Access the Service through automated means (bots, scrapers) without permission
  • Interfere with or disrupt the Service or its infrastructure

8. Intellectual Property

  • The <divs> name, logo, platform code, and documentation are our exclusive property.
  • Components in the shared library are provided for use within the platform. Redistribution of library components outside the context of the Service is not permitted.
  • You retain ownership of components you create using the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee:

  • Uninterrupted or error-free service
  • That the Service will meet your specific requirements
  • The accuracy, reliability, or completeness of AI-generated output
  • Availability of the Service at any particular time

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability to you for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
  • We are not liable for any damages resulting from AI-generated content, including claims of infringement, inaccuracy, or harm.

11. Dispute Resolution

  • Binding Arbitration. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration, not in court, except for claims that may be brought in small claims court.
  • Class Action Waiver. You agree to resolve disputes with us on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions.
  • Governing Law. These Terms are governed by the laws of the State of Maryland, USA, without regard to conflict of law principles.

12. Changes to Terms

  • We may update these Terms at any time by posting the revised version on our website.
  • Material changes will be communicated through the Service or via email.
  • Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Termination

  • You may cancel your subscription and stop using the Service at any time.
  • We may suspend or terminate your access for any reason, including violation of these Terms, with or without notice.
  • We reserve the right to discontinue the Service at any time.
  • Upon termination, your right to use the Service ends immediately. We are not obligated to retain your data.

14. Assignment

We may assign or transfer these Terms and our rights under them to a successor or acquirer without your consent.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and <divs> regarding your use of the Service.
